Acceptance

By accessing, browsing, running, or otherwise using Phantom Tide in any way, you confirm that you have read, understood, and agree to be bound by this notice in full. If you do not agree, you must cease all use and remove any local copies of the software immediately. Continued use following publication of any revision to this notice constitutes acceptance of the revised terms.

Safety-critical and navigational systems

Phantom Tide is not a navigational aid, maritime safety system, aviation dispatch authority, emergency management tool, or safety-of-life system of any kind. It must not be used as the sole or primary basis for navigation, collision avoidance, distress response, search-and-rescue coordination, or any other decision where human safety, vessel safety, or aviation safety may be affected.

Data feeds aggregated by the platform may be delayed, incomplete, malformed, absent, or derived from sources with their own accuracy limitations. No reliance should be placed on platform output in any safety-critical context.

Ownership and intellectual property

Phantom Tide, including its source code, interface design, documentation, branding, visual assets, data schemas, rule definitions, and all original project materials, is proprietary to James Sawyer / JS Labs and is protected by copyright, trade-secret, and other applicable intellectual-property laws.

No right, title, or interest in any intellectual property is transferred by this notice or by use of the platform. All rights not expressly granted are reserved.

Permitted use

Use is permitted only for the following purposes, subject to full compliance with this notice and all applicable laws:

  • Personal research and evaluation.
  • Internal review, testing, and non-public demonstrations.
  • Private development work expressly authorised in writing by the project owner.

Restricted use

The following uses are not permitted without prior written permission from the project owner:

  • Commercial hosting, resale, white-labeling, rebranding, or SaaS operation of any kind.
  • Redistribution of the platform, its source code, compiled outputs, or interface assets in whole or in part.
  • Operation as a managed, professional, or subscription service for third parties.
  • Removal, concealment, or modification of ownership, copyright, or attribution notices.
  • Bulk extraction, scraping, or republishing of project-curated data products, derived analytical outputs, or hypothesis overlays.
  • Use in any context where platform output could reasonably be mistaken for authoritative navigational, legal, regulatory, or emergency guidance.
  • Sublicensing or assignment of any rights under this notice to any third party.

No professional or regulatory advice

Nothing on this platform constitutes legal advice, sanctions-compliance guidance, export-control determinations, financial advice, insurance assessment, flag-state opinion, or regulatory guidance of any kind.

Users must independently verify all material facts using authoritative systems and consult appropriately qualified professionals before taking any operational, regulatory, commercial, or safety-critical action based on information obtained through this platform.

Third-party data and rights

Phantom Tide displays and processes information originating from third-party providers including public maritime registries, meteorological agencies, aviation authorities, satellite data programs, and government information services. Each upstream source remains subject to its own terms of service, licences, rate limits, attribution requirements, and usage restrictions.

No claim is made over third-party trademarks, datasets, or provider-owned content. Users are solely responsible for reviewing upstream terms before relying on, citing, or reusing any source-derived material.

Data accuracy and timeliness

Data displayed on Phantom Tide may be delayed, cached, incomplete, geographically imprecise, or entirely unavailable due to upstream collection constraints, network conditions, source API limitations, or collector failures. Freshness indicators are advisory only and may not reflect actual data age or source reliability.

Geometry extraction, rule outputs, and hypothesis overlays are derived analytical products generated by automated processes. They must be treated as starting points for further investigation, not as authoritative or verified determinations.

No warranty

Phantom Tide is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, title, or uninterrupted operation.

The project owner does not warrant that the platform will be error-free, that defects will be corrected, or that the platform and its infrastructure are free of harmful components. Your use of the platform is entirely at your own risk.

Limitation of liability

To the maximum extent permitted by applicable law, the project owner, its contributors, and any associated parties shall have no liability whatsoever to you or any third party for any direct, indirect, incidental, special, exemplary, consequential, or punitive damages of any kind, including but not limited to loss of profits, revenue, data, business, goodwill, anticipated savings, personal injury, property damage, or death, arising out of or related in any way to: (a) your access to or use of, or inability to access or use, the platform; (b) any content, information, or data obtained through the platform; (c) any decision made or action taken in reliance on platform output; or (d) any other matter relating to the platform, however caused and regardless of the theory of liability, even if advised of the possibility of such damages.

The project owner accepts no liability in contract, tort (including negligence), statute, or otherwise. Where applicable law does not permit complete exclusion of liability, liability is limited to the minimum amount permissible under that law.

Indemnification

You agree to indemnify, defend, and hold harmless James Sawyer / JS Labs from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of or access to the platform; (b) your violation of this notice; (c) your violation of any third-party right, including any intellectual-property, privacy, or data-protection right; or (d) any inaccurate or misleading information you submit to or through the platform.

Export, sanctions, and regulatory compliance

You are solely responsible for ensuring that your use of Phantom Tide complies with all applicable export-control laws, trade sanctions, embargoes, and related regulations, including those administered by relevant national and international authorities.

The platform must not be used to support, facilitate, plan, or enable any activity that would violate applicable sanctions regimes, export restrictions, or prohibitions on dealings with restricted territories, entities, or individuals.

Governing law, severability, and entire agreement

This notice is governed by applicable law. If any provision is held unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and all remaining provisions will continue in full force and effect.

A failure by the project owner to enforce any right or provision of this notice does not constitute a waiver of that right or provision. This notice, together with any separate written agreement between you and the project owner, constitutes the entire agreement with respect to its subject matter and supersedes all prior or contemporaneous understandings, representations, and communications.

Changes and contact

This notice may be revised at any time as the project evolves. Material changes will be indicated by an updated effective date at the top of this page. It is your responsibility to review this notice periodically. Continued use of the platform following publication of any revision constitutes your acceptance of the revised terms.

For licensing enquiries, permission requests, commercial-use discussions, or deployment questions, contact the project owner directly before any use beyond personal evaluation or expressly authorised internal work. Unauthorised use may result in legal action.
